Counseling.
Every business faces unique problems. My job is managing those problems on the front end with you. My clients expect me to resolve disputes and to provide guidance on all aspects of their commercial activities. My experience covers a broad range of industries, including financial services, construction, real estate, personal injury and commercial litigation.
I approach everything in a sensible and realistic way that is based on practical rather than theoretical considerations. I think one of the most important part of running a business, and handling your problems, is managing risk on the front end. Know what you are getting into, know what your options are and understand all of the possible outcomes. My job is to assist and guide you on your journey. Think of the bumper guards in bowling. You are the captain of the ship, I’m just here to keep your business from going in the gutter. When the business jumps the guard, I can help manage your risk on the back end.
While we pride ourselves on our ability to take a case through verdict, we also recognize the costs and uncertainty that often comes with drawn out litigation. As business minded lawyers we don’t apply a one size fits all solution to each client. We have successfully negotiated many settlements on behalf of clients and arranged other creative solutions. In every matter, we collaborate with our clients to understand their business objectives and craft strategies to resolve disputes with those in mind.
Another part of my practice that I have enjoyed a great deal is work I have done in estate planning. There is very simple estate planning that should be in place in every household, and I have a good understanding of what that looks like. This is particularly important with families that have minor children, as steps must be taken to properly establish their guardianship and financial care.
Litigation.
I am a trial attorney. I have spent almost a quarter of a century litigating cases, learning first from some of the largest law firms in the country, and then some of the smallest. I understand the importance of attention to detail and each file receives all of my attention. I have litigated cases involving the following areas: premises liability, construction defect, personal injury, business/commercial dispute and every a few criminal defense cases (DUIs). I work will with opposing counsel and work hard to maintain a healthy relationship in order to facilitate the best outcome for my client. I pride myself on my ability to be reasonable and help others get to a position of reasonable in a variety of different negotiations which arise daily on litigation files.
Ultimately, however, my goal is to keep you out of litigation except as a last resort when folks will not be reasonable. Litigation is expensive. Litigation is time consuming, not just for you, but your company, your employees and your resources. Litigation is uncertain. I’ve won cases I should have lost and lost cases I should have won. But sometimes it is a fight we have to fight.
